BY PURCHASING SERVICES THROUGH statusweb.net, YOU "THE CLIENT" AGREE TO BE BOUND BY THE TERMS AND CONDITIONS CONTAINED HEREIN. PLEASE READ THESE "TERMS OF SERVICE" BEFORE SIGNING UP.

HOSTED CONTENT:
All material posted to a statusweb.net are subject to all applicable federal, state, and local laws. statusweb.net will cooperate fully with any and all law enforcment agencies in producing information requested for the purpose of a legal investigation. Furthermore, and regardless of applicable law, sites containing or promoting warez, copyrighted material not owned by the site owner or explicitly authorized for use by the site owner, pornographic images or content, links to warez, copyrighted material not owned by the site owner or explicitly authorized for use by the site owner, pornographic images or content, material judged by statusweb.net as threatening or damaging, hate material, material harmful to children, material supporting or promoting any terrorist activities,or any other material deemed inappropriate, is prohibited. statusweb.net will be the sole arbiter as to what constitutes a violation of this provision. Any accounts found in violation of this provision will be immediately removed without notice or refund.

Now that that's over with . . .

SPAMMING:
The sending of unsolicited email using statusweb.net resources or from an address hosted on a statusweb.net server is expressly prohibited. statusweb.net reserves the right, at its own discretion, to terminate service without notice or refund for violations of this provision. Furthermore, using email accounts not hosted on statusweb.net servers to send unsolicited email promoting sites stored on statusweb.net servers is also prohibited, and will result in termination of services without notice or refund, upon the FIRST confirmed incident.

Due to the inability to trace a users choice to "opt in", statusweb.net prohibits the use of purchased mailing lists whereby the resulting mail will be sent from a statusweb.net server. It is the sole responsibility of the account holder to ensure that all email recipients have "opted in".

TRAFFIC USAGE:
All statusweb.net accounts come with a preset amount of transfer, expressed in gigabytes. The first time an account exceeds this amount (if by no more than 20% of allocated transfer), a notification will be issued offering an opportunity to upgrade. Subsequent overages will be billed at a rate up to $3/GB unless otherwise documented during signup. Traffic is always measured in 1GB increments and overages will not be prorated.

BACKUPS:
In the normal course of business, statusweb.net will NOT be responsible for maintaining backups of client email or web files. Each client is responsible for maintaining their own backups as provided by the control panel, "phpmyadmin" utility, or any other software chosen to archive site data. statusweb.net shall not be held responsible for any lost data, web files, or any web site contents, regardless of the reason for data loss.

BILLING:
statusweb.net is NOT responsible for sending out invoices for credit card purchases. All credit cards are billed automatically monthly, quarterly or yearly depending on the package chosen. It is the clients responsibility to ensure that there are sufficient credit to cover recurring transaction. In the event that charges fail, an email notification will be sent to the address on file notifying the customer of the failure. Accounts in default for ten (10) days or more will be subject to suspension. Accounts suspended due to non-payment will be subject to a reactivation fee of $30.00 to be paid prior to reactivating the account. Suspended accounts will be removed from the servers permanently after three (3) days.

30-DAY GUARANTEE:
statusweb.net is very proud to offer it's clients an unconditional 30-day money back guarantee. We are confident that you will be very happy with our service, but should you become unsatisfied at any time within the first 30 days after your account activation, statusweb.net will refund your entire hosting fee excluding any applicable setup charges. Domain Registration Fees are non-refundable, and customer will retain ownership of domain after cancellation. This 30-day guarantee does not apply to accounts in violation of these Terms of Service, or to individual domains in a multidomain account.


LIMITATION OF LIABILITY:
Hardware and software failures sometimes occur and are not within the control of statusweb.net. statusweb.net uses quality parts to reduce the possiblity of a failure, and will do everything possible to minimize the impact of a failure, should it occur. statusweb.net shall not however be responsible for any claimed damages, including incidental and consequential damages, which may arise from statusweb.net servers going off-line or being unavailable for any reason. Furthermore, statusweb.net shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site on one of statusweb.net servers. All damages shall be limited to the immediate termination of service.

RESERVED RIGHTS:
In addition to the above mentioned items, statusweb.net reserves additional rights as a part of this agreement. statusweb.net acting in the best interest of the majority of its customers, reserves the right to suspend or remove an account from the system without reason, so long as any unused portion of the amount billed to the client is refunded. This refund will not include any applicable setup charges or activation fees. Furthermore, in the event that suit is brought against statusweb.net, the laws and regulations of the State of Florida, County of Pinellas, will be upheld.
